Performance-based Compensation in the Cosmetics Industry
A law firm needed an executive to testify about performance-based compensation levels for CEOs in the cosmetics industry. Owing to close relationships among cosmetics firms in the New York area, the law firm could not find a local expert willing to critique practices at a competitor. This law firm called Evalueserve Circle of Experts for quick results. Utilities Regulatory Compliance
An investment client required an expert to interpret commercially reasonable energy purchasing policies – a utility required to be implemented under the Public Utility Regulatory Policies Act of 1978. This would decide whether the utility in which the client had invested would be subject to penalties or price controls. As later affirmed by the regulating agency, our expert witness argued persuasively that new technologies and alternative energy sources made PURPA’s price controls irrelevant to the utility’s conduct, thus, increasing the utility’s market valuation.
Employee Discrimination in the Tableware Industry
A law firm was representing an executive who had been terminated by a tableware company – an NJ subsidiary of a European company. He was suing his former employer alleging age discrimination against him, while the employer claimed that adverse economic conditions had provoked the termination. Within days, we introduced him to a former CEO of a competitive tableware vendor, who carried considerable credibility in court when he testified about the economic conditions prevalent in the industry. We then provided him a lawyer with extensive court experience for “piercing the corporate veil.”
